What are the 4 categories of construction defects?

It's not uncommon for new home purchasers to complain of mold, leaks in the roof, cracks in the walls, malfunctioning windows and more. A lot of new construction homes have these kinds of problems. When the new home purchasers and the builders cannot come to a workable agreement, these situations may lead to litigation.

Courts generally organize problems that lead to construction defect litigation into the following categories:

Design defects: These relate to mistakes made by architects and engineers when designing your home. Sometimes, the contracting firm that built the property did everything according to specifications, but due to design, defect problems develop. These problems might result in poor drainage, bad structural support, code violations, water penetration and more.

Material defects: Sometimes builders use cheap or inferior materials to build a home. These material deficiencies could lead to serious structural and other problems that require replacements and/or repairs to be made.

Construction defects: These might include dry rotting wood, cracks in the walls, electrical malfunctions, leady plumbing and pest infestations that result from mistakes, errors and negligence during the construction process.

Subsurface defects: Homes need to be constructed on stable foundations. When the foundation is not appropriately prepared, or when a home isn't built on solid ground, it can create drainage problems, cracked foundations, sinkhole damage and landslide catastrophes.
