Construction dispute delays opening of Florida timeshare tower

Most cases involving construction litigation or disputes occur between a property owner and the contractors hired to work on the property. However, sometimes a dispute can arise between a property owner and one or more entities that are not connected in any way.

This is what has happened in Florida's Orange County. Westgate, a "timeshare giant" has completed work on a tower near the Orange County Convention Center. However, Westgate has not been allowed to open its tower because it is embroiled in a dispute with a neighboring private property owner.

Reportedly, the private property owner refused to sell her vacation villa, which sits right beside the tower, to Westgate. The company chose to build its tower anyway and during construction, it damaged the villa. According to reports, the owner has refused Westgate's numerous offers to remedy the situation.

This dispute between the property owner and Westgate is not the timeshare company's only legal trouble. Orange County has refused to give Westgate permission to open the tower. These two entities may soon face a judge who will make a ruling on this construction dispute.

Westgate is asking the court to force Orange County to let the tower open. For its part, Orange County asserts that Westgate created its own problems by "demolishing buildings without a permit" and has known for some time that the problems must be corrected.

The County issued code violations to both the private property owner and to Westgate, but the two parties have not been able to reach a resolution and begin to repair the villa. Ultimately, it will be up to a judge to decide how these potential construction litigation issues will be resolved.
