Courts see rising child custody cases involving addicted parents

Police knew they would stir up emotions when they posted a certain picture to their Facebook page, and they were right. The image went viral, causing a world-wide reaction, and prompting much needed discussion about the growing heroin epidemic in Florida and across the country. Additionally, the photo generated questions about child custody issues, especially in families with generations of drug addiction.

The photo depicted a man and woman unconscious in the driver and passenger seats of an SUV. Blurred in the background was the face of a child who was strapped in his car seat. The 4-year-old boy was the unconscious woman's grandson. She had been granted custody of him only six weeks earlier after the boy's maternal great-grandparents relinquished him due to their advancing age. They had been raising him since birth because the child's parents were ruled unfit because of their drug history.

The great-grandmother had requested that the court place the child with her daughter, the boy's aunt. However, when the paternal grandmother intervened, the judge awarded her custody despite the woman's past troubles with alcohol. Police found the unconscious woman and her boyfriend after the boyfriend nearly drove into a school bus full of children.

The boy has been permanently placed with his aunt and uncle, and authorities assure those who are following the story that he will be happy and well loved. People in Florida who are seeking custody of children because of parental drug use are not alone. The number of child custody cases involving some addiction seems to be growing. Those who are willing to bring such a child into their families benefit from the determined representation of a family law attorney.
