In our previous post, we began looking at the issue of unlicensed contractors, their increasing use here in Florida, and the issues for consumers who run into problems with them in the course of a job. Much of the risk surrounding the use of unlicensed contractors involves the lack of recourse of consumers when work is done improperly.

Going with an unlicensed contractor—knowingly or unknowingly—can lead to; lack of inspection by building code authorities; voiding of product warranties; denial of insurance coverage; redoing the work properly; no entitlement to recovery under state recovery funds; and inability to sell the property later on without fixing the problems caused by an unlicensed contractor. 

As we mentioned, state law does provide certain protections for consumers who become involved with an unlicensed contractor. For one thing, state and local regulators often impose civil and even criminal penalties upon unlicensed contractors, and consumers can report them to the proper authorities.  Additionally, there are other protections available at the state level, such as protection from lien enforcement, forfeiture of contract, and entitlement to certain type of damages. Consumers should be aware of these rights and work with an experienced attorney to take advantage of available remedies.

Working with an experienced attorney in such cases is important not only to ensure one understands the legal remedies available, but that one builds the best possible case and has guidance seeking damages from an unlicensed contractor. An experienced advocate can also help guide a consumer through any legal actions taken by an unlicensed contractor to recover damages for unpaid work and materials.
