Filing a lien? Legal guidance can be critical

In any professional relationship, ideally both parties gain something valuable, whether that is the completion of services or compensation. In general, this is exactly what happens and both parties walk away from an agreement with their needs met. However, this doesn't always happen.

For instance, let's consider a subcontractor providing services on a construction site. If he completes the work he promised, he should be paid accordingly, right? In ideal situations, the answer would be yes. In other situations, unfortunately, the answer is no and he has to figure out a way to get what he what he was promised. This is where filing a lien may become necessary.

Filing a lien may not be your ideal solution if you are in this type of situation, but it can be extremely effective and quite necessary in order to get what you deserve from another party.

But liens can be very complicated, as they involve meeting deadlines, submitting the appropriate paperwork and filing the appropriate notices to perfect a lien. The process can be far more complex than people initially realize which is why it is important that you not take this option lightly.

If you are in a position to file a lien, you will want to first be sure that other options for fulfilling an agreement have already been considered. In some cases, you can negotiate an alternative solution. You will also want to be sure that you are legally permitted to file a lien in the first place. Finally, you should know what you can expect to happen in order to have the lien discharged.

Considering how much there is to know about this process, we encourage readers with questions about liens to consult an attorney like those at our law firm who are well versed in the various elements of construction liens.
