Mold in your home: Know the signs, know your options

Homes all across Florida are vulnerable to certain elements that can compromise their safety and structural integrity. For instance, the moisture and humidity in this state makes it very common for mold to grow in homes.

However, if you start seeing or smelling mold in a home that has recently been constructed or after certain features have been installed to inhibit mold growth, it could be a sign of defective construction.

When you are looking for signs of mold, you should know what you are actually looking for. According to the Centers for Disease Control and Prevention, mold can be:

  • Spotty
  • Any number of colors, including black, brown, gray, green and even pink in some cases
  • Musty

Additionally, it often grows in damp areas and typically spreads easily on materials like paper, cardboard and drywall. Some signs that you might have mold growing in your home could include symptoms like:

  • Coughing
  • Wheezing
  • Nasal congestion
  • Lung infections
  • Eye or skin irritation

If you have identified mold in your home, you should act fast to address the situation. If your home is older and in need of repair, there are plenty of ways to clean it the mold and you would be wise to fix the elements that are contributing to its growth.

However, you should know that there are cases where the mold is the result of defective construction. This means the mold is growing because of something in your home that was improperly designed, manufactured or installed. In these cases, you can take legal action to have a negligent party repair the damage and/or cover the costs of mold abatement and repairs.

Negligent parties can include designers who created plans with poor drainage or leak protection, subcontractors who failed to properly install housing materials or manufacturers of substandard products.

Considering the fact that your health, your home and your financial stability can be compromised by mold growth and other construction defects, it can be crucial that you assess your legal options with an attorney if the mold could be the result of negligence.
