Seeking alimony in a Florida divorce

Divorce is nearly always a difficult and emotional process. It involved the end of a household and new relationships between individuals. Two groups who often feel the most change in lifestyle are children and former spouses with no or little income.

These concerns are particularly high in Florida, where the divorce rate is 4 per 1,000 people. This is the seventh-highest rate of any state in the United States. With other public health concerns posing dangers to Floridians, the Sunshine State places stress on married couples, possibly increasing the chances of divorce.

The welfare of children is handled with focus on the best possible option for a child's safety and happiness. The financial maintenance of a spouse who has become accustomed to a standard of living under the marriage may seek alimony payments to support himself or herself for a period of time after the divorce.

If a divorcing spouse requests alimony, the judge has to determine if that person needs it and if the other spouse can pay it. The judge may determine that alimony should be paid for a period of time or indefinitely. Some conditions might be set based on the length of the marriage and individuals' standards of living during that time.

Decisions on alimony are largely made on a spouse's ability to support themselves. Spouses seeking alimony during a divorce process may consider legal representation to make sure all arguments regarding alimony are heard by the judge. An attorney may assist a successful application for alimony.
