THE DANGERS OF GOING TO COURT PRO SE (WITHOUT AN ATTORNEY) IN FAMILY MATTERS.

Today many divorcing couples are trying to avoid potentially expensive divorces.  The problem is that many of these couples are simply choosing not to consult attorneys at all and therefore are not being apprised of what options they have to accomplish their very goal; including collaborative or amicable divorce, pre-suit mediation, hiring an attorney on a limited basis, or filing an uncontested divorce.

Instead, couples are choosing to navigate the family court system without counsel, what the court refers to as a case with "pro-se litigants". We have seen time and time again, clients who come to us after being fed up with the system, the time commitment, or the work involved.  Pro-se parties have to wait for the local pro-se coordinator to help them schedule any hearings in front of their presiding judge.  This means they are typically at the back of the line when it comes to scheduling, as attorneys are allowed to schedule their own hearing time. 

Additionally, pro-se scheduled hearings are frequently canceled because the parties have not filed the proper documents or have not properly filled out the paperwork they have filed.  We have had numerous encounters with people who were surprised to learn that they could not simply file "correctly-titled" paperwork and get divorced even though the paperwork was incompletely filled out or simply filled in wrong.  A recent example, the parties filed the required Financial Affidavits, but did not sign them or even finish filling them out and could simply not understand why filing was not good enough.  The Judge's assistant will review all paperwork filed with the clerk before any hearing and if it is lacking or not done properly, cancel the hearing.
